Terms of Service

Welcome to Braking Lab. These Terms govern your use of the Service, including the free tier, paid subscriptions (Plus, Ultra and Team seats), and the Founding Membership offer. Please read them carefully — by creating an account or purchasing a subscription you accept these Terms.
1. Acceptance of Terms
By accessing or using Braking Lab (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Service Description
Braking Lab is a free brake training and telemetry analysis platform for sim racers. The Service consists of: (a) a web application for brake training exercises, telemetry analysis, race preparation, and performance tracking; (b) an optional desktop client ('Braking Lab Capture') for Windows that captures real-time telemetry from iRacing and uploads it to the cloud; (c) an AI-powered Race Engineer accessible through third-party AI clients via the Model Context Protocol (MCP); and (d) a public leaderboard where users can optionally share their best lap times. The Service integrates with iRacing for content synchronization, telemetry capture, and racing data.
3. User Accounts
Use of Braking Lab requires a free account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must provide accurate information when creating an account. A small set of partner-integration and informational pages may be accessed without an account; these do not store user data.
4. Acceptable Use
You agree to use the Service only for lawful purposes. You may not: (a) attempt to gain unauthorized access to the Service or its systems; (b) use the Service to transmit harmful code; (c) interfere with other users' enjoyment of the Service; (d) use automated systems to access the Service without permission; (e) manipulate leaderboard rankings through falsified or modified telemetry data; (f) abuse the Race Engineer API through excessive requests, prompt injection attempts, or attempts to extract system prompts; (g) use the MCP server to attempt to access other users' data or bypass authorization controls; (h) reverse-engineer, decompile, or disassemble the desktop client software.
5. User Content
You retain ownership of any content you create, including custom exercises, training data, notes, telemetry data, track notepads, and race preparations. By using the Service, you grant us a limited, non-exclusive license to store, process, analyze, and display this content solely to provide the Service to you. This includes processing telemetry data to generate performance metrics, braking zone analysis, and AI coaching insights. If you opt into the public leaderboard, you grant us a license to display your display name, lap times, track, and car information on the leaderboard. You may delete your content or opt out of the leaderboard at any time.
6. Intellectual Property
Braking Lab and its original content, features, and functionality are owned by Braking Lab and are protected by international copyright and trademark laws. You may not copy, modify, or distribute our content without permission.
7. Third-Party Services
The Service integrates with third-party services, including but not limited to: Garage61 for telemetry import; iRacing for telemetry capture and content synchronization; Anthropic, OpenAI, and other AI providers that you may connect via the Race Engineer; Cloudflare for content delivery and telemetry storage; Railway for server hosting; Sentry for error monitoring; and PostHog for analytics. iRacing® is a registered trademark of iRacing.com Motorsport Simulations, LLC. Garage61 is a trademark of its respective owner. These third-party services are provided by their respective owners and operators, and your use of these services is subject to their respective terms of service and privacy policies. We are not affiliated with, endorsed by, or responsible for the availability, accuracy, or reliability of these third-party services. Any issues arising from the use of third-party services should be directed to the respective service providers.
8. Desktop Software
The Braking Lab Capture desktop client is provided under a limited, non-exclusive, revocable license for personal, non-commercial use. You may install and use the client on Windows computers you own or control. You may not: (a) redistribute, sublicense, or sell the client; (b) reverse-engineer, decompile, or modify the client; (c) use the client with any simulator other than those officially supported; (d) circumvent any usage limits, quotas, or rate limiting implemented in the client. The desktop client may automatically check for and install updates. We may discontinue or modify the desktop client at any time without prior notice.
9. AI Race Engineer Disclaimer
The Race Engineer feature provides AI-generated analysis and coaching based on your telemetry data. ALL AI-GENERATED CONTENT IS PROVIDED FOR INFORMATIONAL AND ENTERTAINMENT PURPOSES ONLY. It does not constitute professional driving instruction, safety advice, or engineering guidance. You should not rely on AI recommendations as a substitute for professional coaching or instruction. AI analysis may contain errors, inaccuracies, or incorrect interpretations of your telemetry data. We make no warranties regarding the accuracy, completeness, or usefulness of AI-generated content. You use AI-generated recommendations entirely at your own risk. By connecting a third-party AI client (such as Claude, ChatGPT, Cursor, or Windsurf) via OAuth, you authorize that client to access your telemetry data through our MCP server. You are responsible for reviewing and accepting the privacy policies and terms of service of any AI provider you connect.
10. Public Leaderboard
The public leaderboard displays lap times submitted by users who opt in. Leaderboard participation is voluntary and can be disabled at any time in your account settings. We do not independently verify the accuracy of submitted lap times and make no guarantees about leaderboard rankings. We reserve the right to remove entries that we reasonably believe were obtained through manipulation, exploits, or modified telemetry data, without prior notice. Leaderboard data — including display name, lap time, track, and car — is publicly visible to all users and may be indexed by search engines.
11. Usage Limits & Quotas
The Service may impose usage limits including but not limited to: telemetry capture quotas (laps per session, sessions per period), API rate limits for the Race Engineer and MCP server, AI Engineer Report generation quotas (lifetime or monthly, varying by tier as published on the Pricing page), and storage limits for telemetry data. Cloud telemetry retention is also tier-dependent: data older than your tier's retention window may be soft-archived (made invisible in the UI but recoverable on tier upgrade) per the policy on the Pricing page. These limits may vary between free and paid tiers and may be modified at any time without prior notice. Exceeding usage limits may result in temporary or permanent restriction of functionality.
12. Subscriptions and Pricing
Braking Lab is offered with a free tier (Basic) and paid subscriptions (Plus, Ultra and Team seats). The current price, billing cycle (annual or monthly) and the features included in each tier are listed on the Pricing page at brakinglab.com/pricing, which forms part of these Terms by reference. Prices are shown in EUR or USD and are exclusive of VAT, sales tax and similar consumption taxes; the applicable tax is calculated and added by Stripe at checkout based on your jurisdiction, and the final total payable is shown for your confirmation before the charge. EU business customers with a valid VAT identification number may benefit from reverse-charge VAT treatment at checkout. Payments are processed by Stripe Payments Europe, Limited ("Stripe"); we do not store full card numbers on our servers. Team plans are seat-priced: the team owner pays for each member according to the member's personal plan at the time the seat is added or recomputed at the owner's renewal anniversary. The features bundled with each tier may evolve over time; any change that materially reduces the features available at a tier you have already paid for will be notified in advance under the Price Changes section below.
13. Automatic Renewal and Cancellation
Paid subscriptions renew automatically at the end of each billing period (annual or monthly) at the then-current price for your tier, unless you cancel before the renewal date. You may cancel at any time from the Stripe Customer Portal accessible from your account, or by contacting us at hola.rdiaz.racing@gmail.com. If you cancel, your access to paid features remains active until the end of the current paid period; we do not pro-rate refunds for unused time, except as required by the Refund Policy and Right of Withdrawal sections below or by applicable mandatory consumer law. Failure to pay (e.g. expired card, declined charge) may result in your subscription being downgraded to the free tier after a grace period of up to thirty (30) days, during which Stripe retries the failed charge; you may restore your subscription by updating your payment method before the grace period ends.
14. Founding Membership
During the Founding window, eligible customers may purchase the Ultra annual plan with a permanent discount (the "Founding price") and a limited number of free Team seats included with their Ultra subscription. The Founding price applies only to the Ultra annual plan; it does not apply to monthly billing, the Plus tier, or any non-Ultra-annual plan. The Founding price applies for as long as your Ultra annual subscription remains continuously active and survives renewals and increases of the standard Ultra annual price. If you switch your active subscription to a plan to which the Founding price does not apply (for example, Ultra monthly), the Founding discount does not apply to charges on that other plan; if you switch back to Ultra annual while the same subscription remains continuously active, the Founding price resumes. The Founding price is personal and non-transferable; it cannot be assigned, sold or shared with another account. If you cancel your subscription, lapse on payment past the grace period, or otherwise let the subscription lapse, you permanently lose the Founding price; if you re-subscribe later you will pay the then-current standard price. Free Team seats granted under the Founding offer apply only while you remain on a Founding-eligible plan and within the cap published on the Pricing page; seats added beyond the cap are billed at the standard seat price for the relevant bucket. We may close the Founding window at any time without prior notice; closure does not affect customers already enrolled at that moment.
15. Right of Withdrawal (EU Consumers)
If you are a consumer resident in the European Union, you have the right to withdraw from a paid subscription within fourteen (14) calendar days of the contract date, without giving any reason, in accordance with Articles 102 and following of the Spanish Royal Legislative Decree 1/2007 (TRLGDCU) and Directive 2011/83/EU. To exercise this right, please send a clear statement to hola.rdiaz.racing@gmail.com identifying the subscription and your wish to withdraw, or use the cancellation flow in the Stripe Customer Portal. EXPRESS REQUEST AND WAIVER FOR DIGITAL SERVICES (Art. 103.m TRLGDCU): by checking the consent box at checkout and starting to use the paid features before the 14-day period elapses, you expressly request that performance of the digital service begin during the withdrawal period and acknowledge that you will lose your right of withdrawal once the service has been fully performed. If you do not start using the paid features during the withdrawal period, your right of withdrawal remains intact for the full 14 days. Where the right of withdrawal applies and is exercised on time, we will reimburse all payments received from you for the affected period without undue delay and in any event no later than 14 days from the day on which we are informed of your decision.
16. Refund Policy
Beyond the statutory right of withdrawal, we offer a 14-day money-back commercial guarantee on your first paid subscription with Braking Lab. If you are not satisfied within fourteen (14) calendar days of your first paid charge across the Service, contact us at hola.rdiaz.racing@gmail.com and we will refund the charge in full to the original payment method via Stripe; refunds are typically processed within five to ten business days. The 14-day guarantee applies only to that first paid charge: it does not apply to subsequent upgrades between tiers, renewal charges (annual or monthly), seat additions on Team plans after the initial purchase, or subscriptions that have already been refunded once. Outside of the statutory withdrawal period and this commercial guarantee, paid subscriptions are non-refundable for unused periods. Nothing in this section limits any mandatory refund right you may have under applicable consumer protection law.
17. Price Changes
We may change the standard price of any paid tier or seat bucket at any time. Price changes do not apply retroactively to invoices already issued. For active subscriptions, price changes take effect at the start of the next renewal period and we will notify the account email at least thirty (30) days before that renewal. If you do not accept the new price, you may cancel before the renewal date, in which case your access continues until the end of the current paid period and the subscription does not renew. Customers enrolled at a Founding price are not affected by increases in the standard Ultra price for as long as their subscription remains continuously active, as described in the Founding Membership section.
18. Disclaimer of Warranties
THE SERVICE, INCLUDING THE WEB APPLICATION, DESKTOP CLIENT, AI RACE ENGINEER, AND ALL CONTENT GENERATED THEREBY, IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) telemetry data will be captured, transmitted, or stored without loss or corruption; (c) AI-generated analysis or coaching will be accurate, complete, or useful; (d) leaderboard rankings will be accurate or free from manipulation; (e) the desktop client will be compatible with all hardware configurations or system environments. Braking Lab is a training and analysis tool and does not guarantee improvement in racing performance.
19. Limitation of Liability
To the maximum extent permitted by law, Braking Lab and its operators, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to: loss of telemetry data; incorrect, misleading, or incomplete AI-generated analysis or coaching advice; leaderboard ranking disputes; damages arising from the use of third-party AI clients connected via the Race Engineer; hardware or software incompatibilities with the desktop client; or any interruption or discontinuation of the Service.
20. Termination
We reserve the right to terminate or suspend your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the Service. Upon termination, your license to use the desktop client is immediately revoked, and you must uninstall it from all devices. We may also remove your data from the leaderboard upon termination.
21. Changes to Terms
We may modify these Terms at any time. We will notify users of significant changes by posting a notice on the Service. Your continued use after changes constitutes acceptance of the new Terms.
22. Governing Law and Jurisdiction
These Terms are governed by the laws of Spain, without regard to conflict of law principles. For consumers resident in the European Union, the courts of the consumer's place of residence shall have jurisdiction over any dispute arising from these Terms or the use of the Service, in accordance with Regulation (EU) 1215/2012 (Brussels I bis) and the Spanish Royal Legislative Decree 1/2007 (TRLGDCU). For all other users, the courts of Oviedo (Asturias, Spain) shall have exclusive jurisdiction. The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.
23. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
